Accidents / Allergies

In the event of an accident or emergency, we will contact the Davidson County Ambulance Service to transport the student to the hospital and notify the parent or guardian. It is imperative that you keep the school informed of any change in address or telephone numbers so your child can be treated promptly. If your child has any known allergies, please let us know.

Admission to School

For admission to school the following must be provided:

  1. Birth Certificate

  2. Physical examination

  3. Immunization Record

  4. 2 proofs of residency (ex. Rent receipt, electric bill, telephone bill, Medicaid card)

Students who do not meet these conditions within 30 days of enrollment will be suspended until they are met.


It is important that your child attends school each day possible. The school is required to notify you when your child misses 3,6, and 10 days. Students must bring a written excuse from their parent or guardian stating the reason for the absence. Failure to do so will result in the absence being recorded as unexcused. When students have more than 10 unexcused absences, it is a violation of state Mandatory Attendance Law and parents can be taken to court. Attendance has been added to Lexington City Schools Promotion/Retention Policy. Promotion/Retention Policy can be found in the School
Board Policy Section of this handbook. Also, the Tardy Policy makes 5 unexcused tardies equal to 1 day absent from school. The absence then applies to the state Mandatory Attendance Law and LCS Promotion/Retention Policy.

Behavior and Discipline

To maintain a safe and orderly environment, it is important that all students follow basic school rules.

  4. I will remember that I have people who care about me in my family, school and community.

Bathroom Procedures

At Charles England we focus our attentions on academic achievement. We feel instructional time is very important. We have developed a bathroom procedure, which will reduce student’s time away from class. Each student will receive 3 passes to go to the restroom throughout the day. Our goal is to allow our students to go the bathroom based on their needs instead of waiting in line as a class. This will also limit the number of students who are in the bathroom at one time, which should reduce the amount of time students are out of class. If a student has a medical reason to go to the restroom more often we will certainly work closely with the parent/guardian and the medical professional in order to meet their individual needs.


If arranged with the classroom teacher, a parent may bring in items to celebrate a student’s birthday. All food items must be store bought. Students are not allowed to receive items such as balloons or presents at school.


Breakfast will be served to all students in the cafeteria from 7:00 – 7:40. Breakfast is free to all students.


Riding the bus is a privilege that can be taken away from students who continuously misbehave, disrupt and cause an unsafe environment for passengers and the driver. Students who continue to be unsafe could be suspended from the bus for the rest of the school year. Students who ride the bus are expected to follow bus rules that will be discussed the first week of school.

  1. Students will sit in their assigned seat

  2. Students will keep book bags in laps

  3. Students will talk quietly

  4. Students will keep hands and feet to themselves

  5. Students will exit quickly and quietly off the bus

When a child breaks a bus rule, the bus driver will turn in a report to the school office. All reports will be investigated by an administrator. Consequences will be given for inappropriate and unsafe behavior. These can include a warning, bus suspension, or other action deemed appropriate by the school administrator. An attempt will be made by the school office to notify the parent of the referral and whether it will be necessary to suspend your child from the bus.

Calling the School

Telephones in the classrooms do not ring out until 2:30pm. This is done to reduce the disruption of the teaching/learning process. When you call before 2:30 pm, your call will be transferred directly to the teacher’s voice mail so you can leave a message. If you are calling because of an emergency or to make a change in your child’s transportation home, please call the school front office. Our Secretary will make the appropriate contacts with the teacher. We encourage you to write notes or email the teacher when possible since they can be handled more quickly and efficiently in most cases. Children are not allowed to receive calls directly at school.

Car Riders

Morning: Morning car riders should enter Cornelia Street from Raleigh Rd. /W. Martin Luther King Jr. Blvd. Students should remain in their cars until a staff member opens the car door. Students will be admitted to the building through the cafeteria doors from 7:00 to 7:40. After this time, students must be driven around to the front entrance and escorted in by a parent for a tardy pass.

Afternoon: Car riders will dismiss at 2:30. Please use the Raleigh Rd. /W. Martin Luther King Jr. Blvd. to Cornelia Street entrance and stay in your car. We will give you a sign with your child’s name on it to display in your window to assist us in a safe and fast dismissal. You must have the car rider sign in order to pick up your child. Please pull up close to the curb. Staff members will assist with loading students in vehicles. Students not picked up by 2:45 must be signed out from the front office.

Child Protective Services

State law requires any citizen who suspects a child is being abused or neglected to make a report to Child Protective Services. Regardless of where a report is made, social workers are permitted to come to the school to interview children about various allegations. The school is not at liberty to discuss any reports made to Child Protective Services since all calls are confidential and many are anonymous.


Conferences are scheduled on October 27th and March 24th. Parents are encouraged to make arrangements to attend these conferences. Conference times will be in 15 minute increments. Transportation and interpreters are available upon request. A third conference will be scheduled if your child is experiencing difficulty after the second nine weeks.

Contact Information

It is important that you give us several ways to reach you in case of an emergency. If your phone number changes or is disconnected, please give us the number of a friend or relative that we may contact. If we can’t reach you in case of a true emergency (children left at school, medical emergencies, etc.), we will contact local law enforcement officials or Child Protective Services for assistance.


Car riders and walkers will be dismissed at 2:25 pm. We will begin calling individual buses as soon as car riders are out of the hall. For safety reasons, students will not be dismissed from the bus lot area or from the bus line. You must come into the office, present picture identification, and sign your child out. It will count as an early dismissal if your child is signed out before 2:25.

  • If you must call to make a change in how your child will go home, please try to do so before 1:00 pm. This will allows us plenty of time to contact the teacher prior to dismissal beginning.

  • Parents/legal guardians must send a note to the teacher if there is to be a change in the way a child is to go home. If a child does not have a note, he/she will go home in the usual manner. We will not take the child’s word that there is a change in the way they are to go home.

Dress Code:

Charles England Elementary School participates in the Lexington City Schools Standard Mode of Dress policy. The board has adopted this policy and is stated below. If you have any questions about the Standard Mode of Dress, please feel free to contact the front office at (336) 242-1552.


Beginning with the 2009-2010 school year, all students in Lexington City Schools (LCS) are required to wear Standard Mode of Dress (SMOD). The Lexington City School Board of Education believes a safe and disciplined learning environment is essential to maximize student achievement and to ensure that students reach their full potential. The implementation of SMOD will promote respect for oneself and others, build school spirit, decrease unhealthy competition involving fashion trends, reduce the strain on parental clothing budgets, and allow for easy identification of intruders on campus.

Information Dissemination

School officials will communicate with parents/guardians information concerning the uniform policy through newsletters, parent meetings, parent/student handbooks, media (newspaper, TV, and/or radio), flyers, and posters.


The principal will implement the SMOD policy in a manner that is developmentally appropriate. Good judgment in considering age, developmental stages, and body type are expected of all students, parents, and guardians in the selection of school attire and overall appearance. SMOD must be neat, clean, properly fitted, age-appropriate and suitable for the learning environment. In addition to being required to wear SMOD, all students are expected to be groomed and dressed appropriately for school activities. A student's dress and/or appearance will:

•(1) support, not disrupt, the learning environment;

•(2) constitute no threat to health or safety;

•(3) not be provocative or obscene; and

•(4) reflect practices of good hygiene and cleanliness.

Waiver/Opt-out Requests

Reasonable consideration will be given for students who request a waiver of a particular guideline for dress or appearance because of a sincerely held religious belief or medical issue. The parent or guardian must submit a waiver request in writing on the Waiver Request Form to the school principal or the principal's designee on an annual basis. In considering a waiver request, the principal and/or principal's designee have the right to request additional documentation from medical officials and/or religious leaders.

Reasonable Accommodations

The principal or the principal's designee will make reasonable accommodation for students involved in special duties, activities, or projects approved by the school. This could include but not be limited to athletics, career and technical education, physical education, special events, and other activities that require non-conforming dress on a school campus during a school-sponsored event. Students may be excused from wearing SMOD during special school events such as Homecoming, Spirit Day, Picture Day, or others as named by the principal or designee. SMOD will be optional for students who attend the South Lexington Developmental Center.

Financial Considerations

Parents and/or guardians who have concerns about the affordability of a school uniform should contact the school guidance office. The guidance counselor will assist the family with identifying community resources. Students who enroll in Lexington City Schools during the school year will be given support during the enrollment process to assist with immediate compliance to the SMOD Policy. The school system will not be responsible for funding SMOD for students. Each school will maintain a SMOD Closet to provide appropriate attire when students are not dressed in SMOD, to assist new students, and to facilitate the recycling of SMOD garments within the school community.

SMOD Requirements

•A. Shirts, Sweaters, Sweatshirts, and Coats

•1. PK-12 students must wear shirts with a collar and sleeve and may choose from the following solid colors: white, gray, navy blue, royal blue, or orange.

•2. With the exception of school insignia/logos, shirts may not have logos, labels, words, or pictures larger than one square inch.

•3. Shirts must be appropriately sized and must hang no more than three inches below the hip bone. Shirts with "tails" or uneven bottoms, or any shirt that hangs more than three inches below the hip bone must be tucked in. Shirts must be long enough to cover the midriff.

•4. Undergarments may not be visible at any time.

•5. Students may wear a SMOD-colored T-shirt or SMOD-colored turtle neck under the SMOD collared shirt.

•6. No see-through or mesh clothing that will reveal the body or undergarments will be allowed.

•7. Clothing will be worn appropriately (not inside-out or backwards, not partially on, etc.).

•8. Students may wear a SMOD colored sweater or SMOD colored sweatshirt without pockets over the SMOD shirt.

•9. Coats may not be worn inside the classroom. Exceptions may be made by the principal or designee in the case of heating malfunction.

•10. Coats, SMOD colored sweaters, and SMOD colored sweatshirts with "hoods" are acceptable, but the student is prohibited from wearing the hood on the head while inside any school building.

•B. Pants, Skirts, Skorts, Jumpers, Capri Length Pants, Shorts

•1. Colors: solid khaki, navy blue, or black

•2. With the exception of school approved logos, pants, skirts, jumpers, capris and shorts may not have logos, labels, words, or pictures larger than one square inch.

•3. All must be free of graphics, laces, and embroidery.

•4. Shorts, skirts, skorts and jumpers will be no shorter than three inches above the top of the knee when standing.

•5. No splits or slits in skirts or pants will be allowed.

•6. No jeans or overalls will be allowed.

•7. No cargo pants or cargo shorts will be allowed.

•8. Form fitting or skin tight material, bedroom pants, lounge pants, or exercise pants will not be allowed.

•9. Clothing must be appropriately sized. No baggy or sagging pants or shorts are allowed. No "low rise" clothing is allowed. Pants with a waist below the hip bone must not be worn.

•10. Pant bottoms cannot have ragged or torn edges and cannot drag on the floor.

•11. Clothing will be worn appropriately (not worn inside-out or backwards, no rolled up pants legs, or no pants tucked into shoes or socks).

•12. No see-through or mesh clothing that will reveal the body or undergarments will be allowed.

•13. If worn, belts must be appropriately sized, buckled and not hanging below belt loops. Buckles should be plain and regular size, no larger than a credit card. Students will be given a belt to wear during the school day if pants are not appropriately sized.

C. Footwear

•1. Shoes that have laces must be laced and tied. Laces must match shoe color or be black, brown, or white.

•2. No bedroom shoes, "Heelies," spike heels, or any shoes with heels greater than three inches will be allowed.

•3. No flip flops for students in grades PK-5.

•4. Sock colors: black, brown, gray, navy blue, white, and SMOD colors

•5. Socks must match each other and, if worn, must be worn on both feet.

D. Accessories

•1. Jewelry cannot be a distraction to the learning environment or present a safety hazard.

•2. Jelly bracelets are not permitted.

•3. No adornment is allowed that reasonably could be perceived as or used as a weapon (such as chains or spikes).

•4. No sweatbands, head wraps, hats, doo-rags, skull caps, bandanas, picks, or combs will be worn inside school buildings.

•5. Students may wear neckties with SMOD colored dress shirts. If worn, neckties may be any color or design as long as they are not disruptive to the educational process.

•6. Leggings in any SMOD color may be worn only as an accessory under skirts, skorts, dresses, shorts, pants, or capris that meet SMOD requirements.

•7. No pins, buttons, stickers, or other items which are patently vulgar, lewd, offensive, or which materially and substantially interfere with the education process are permitted to be worn on a student's SMOD. Any allowable pins, buttons, stickers, or other items shall be no more than 3 inches in diameter.

•8. Sunglasses may not be worn inside the building.

E. Hair

No "cut-ins" in hair or brows will be allowed.

Consistent Enforcement

The principal or the principal's designee will ensure that the SMOD policy is enforced in a consistent manner and require the student and the student's parent or guardian to take appropriate action to remedy situations determined to be in conflict with this policy. Disciplinary action will be taken for violation of the SMOD Policy in accordance with the LCS Board of Education Code of Student Conduct. Appropriate disciplinary actions for violations will include the following:

First Offense: Students will be informed that they have violated the policy. They will be given the opportunity to change into acceptable clothing by using available clothes at school or by calling a parent/guardian to bring clothes. If the student refuses, he/she may be placed in in-school suspension for the remainder of the day.

Second Offense: A second infraction of the policy will be considered defiance. In addition to the disciplinary actions available for a first offense, a parent/guardian conference will be held.

Third (and additional) Offenses: A third or additional infraction of the policy will be addressed according to Board Policy entitled "Disruption of School" and disciplinary action may be imposed by the principal pursuant to Board Policy 5.3.4 entitled "Consequences of Serious Student Misconduct."

Early Dismissal

There will be 5 early dismissal days for students during the 2015 –2016 school year.

September 28, October 26, January 20, March 23, June 7. Students in grades 1-5 will dismiss at 11:30 on those days.

Early Sign Out

Students who must leave school before 2:25 pm have to be signed out in the office by an adult. Signing students out of school early is a disruption of the instructional day, so please do so only when absolutely necessary. Also, leaving early for an unexcused reason will count toward the tardy policy. Five early sign outs and/or tardies equal to one absence.

Electronic Devices

Students should not have electronic devices at school. They disrupt the instructional learning that takes place in the classroom. Some examples of electronic devices, but not limited to, are laser pointers, radios, CD players, MP3 players, cell phones, and any hand held games. Should a student have an electronic device in class, the teacher will collect the item and give it to an administrator. Parents/legal guardians will be required to come to the front office and collect the item from an administrator.

Friday Folders

Folders will be sent home each Friday that contain samples of what your child completed in school during the week. There will also be a behavior report and any other school correspondence that needs your attention.

Grade Placement

According to NC state law, the principal is responsible for grade placement.

Health Problems

If your child has allergies, asthma, or other chronic medical problems that require special care, please provide the teacher with this important information. If medication is required, make sure to have a doctor fill out the long term medication form (available in the front office) and bring the medication to the front office. Do not send medication with students to schools.

Health Services

A Health Department nurse will be in our school on designated days. During the year, we will give routine vision and hearing screenings to students. The nurse will contact the home if she feels medical attention is needed. Medical care is the responsibility of the parent/legal guardian.

Please help your child with homework assignments each night as assigned by the teacher. All students will be given a notebook that they must bring to school each day. The notebook will have all assignments on a weekly homework sheet. You can help your child with homework by establishing a consistent homework time in a quiet place. Be helpful, but please do not do the work for your child. Students will be expected to do all assigned homework as well as read each night. (Monday –Thursday).

Reading Times

1st Grade – 15 minutes
2nd Grade – 20 minutes
3rd Grade – 25 minutes
4th and 5th Grades – 30 minutes

Lice are parasites that live in the hair of human beings. They can be transmitted between children through direct contact with hair or clothing of an infested child. When a child is found to have head lice, parents are called and the child must be sent home for treatment. Students cannot return to school until they have been treated and are nit free. This is the only way to prevent a child from passing the lice to another child. Students are excused for one day to be treated. Absences after that point are unexcused.

  • Regular shampoos have no effect on head lice. The commercial products, such as Nix or Quell, must be used to shampoo the head. This kills the lice; however lice leave behind egg sacks called nits. The nits are attached to the hair shaft and may hatch into more lice even if the child’s hair has been treated. Nits must be combed from the head with special combs. Some lice have become resistant to treatment. You can also use vegetable oil on the hair for 5 hours and then wash the hair with Dawn dish soap. The Health Department can also assist in ridding resistant lice.

  • The day after a child has been treated for lice, the child must be brought to the office by a parent/legal guardian to be checked before they can go to their classroom. If all nits have not been removed, the child will be sent home again. This is done for the protection of all children.

School Board Policy:

To eliminate repetitive outbreaks and epidemics of head lice and constant reinfestations in our schools, Lexington City Schools has adopted a "NO-NIT" regulation.

A student, when found to have head lice, must receive treatment with an appropriate lice (pediculosis) shampoo and ALL NITS (eggs) must be removed before he or she returns to school. The child's head will be screened upon his or her return to school. If nits are found, parents will be expected to pick up the child and keep him or her at home until ALL NITS are removed.

It is recommended that parents bring the child to school on the day of reentry and that they be present when their child's hair is rechecked. If nits are detected, the parent can see the nits that need to be removed. Parents are not required to be present at the recheck, it is only recommended.


Community Eligibility Provision
Lunch at no cost 

The Community Eligibility Provision program will be in place for the 2015-2016 school year. The Community Eligibility Provision (CEP) provides an alternative approach for offering school meals to local educational agencies (LEAs) and schools in low income areas, instead of collecting individual applications for free and reduced price meals. The CEP allows schools that predominantly serve low-income children to offer no cost, nutritious school meals to all students through the National School Lunch and School Breakfast Programs. The CEP uses information from other programs, including the Supplemental Nutrition Assistance Program (SNAP) and the Temporary Assistance Program for Needy Families (TANF) instead of traditional paper applications.


When necessary, students can take prescription medication at school. All medications must be brought to the school and picked up from school by an adult. All medication must be brought to the front office to be stored in a locked cabinet. Children are not allowed to carry medications. Prescription medications must have a complete label on the bottle. A copy of a medication form is in the back of this handbook and must be filled out and returned to the office with any medication to be administered at school. Medication must be prescribed by a physician and provided by the parent. *Parents/legal guardians must provide written consent with detailed directions for administration of non-prescription medicine. *School staff will not give any medications based on consent given over the telephone.

Progress Reports

Progress reports are mailed to your home at midpoint of each grading period. We ask that parents call the school for a conference if you have any questions. Progress reports will be mailed to your home on September 28, December 8, and February 26.


We are fortunate to have a Parent Teacher Organization to work on behalf of our students. PTO will meet the first Thursday of each month at 6:00. We encourage you to be actively involved in the PTO and your child’s education.

Quarterly Assessments

Students will be formally assessed at the end of first, second, and third quarters in order to monitor their academic success. Quarterly assessments for the 2015 – 2016 school year are scheduled for the following dates:

2nd 9 weeks January 12th(reading)13th(math)14th (5th grade science)

3rd 9 weeks March 16th(reading) 17th(math) 18th(4th/5th grade science)

Report Cards

Report cards are completed at the end of every nine weeks of school. Report cards will be issued October 27(conferences), January 20(mailed), March 24(conferences), and June 13(mailed). The first and third quarter report cards will be given to parents during conferences and will be be mailed the second and fourth quarters.

Safety Drills

As required by law, we will have a minimum of one fire drill per month to make sure students are prepared to exit the building quickly and safely in the case of a true emergency. We will also have several severe weather drills to assume a safe position inside the building. In addition to these drills, we will rehearse procedures for other emergency situations. We will also rehearse an Intruder Lockdown Drill monthly. We take each of these drills very seriously and we expect the students to do so as well. If you have any questions about these drills, please contact the office.

School Day

The school day officially begins at 7:40 am and ends at 2:25 pm. Students may enter the building at 7:00 am. Breakfast will be served free to all students. Students arriving after 7:40 must be accompanied to the school office by an adult.

School Property

School Board Policy states that students have a responsibility for proper care of all school property and buildings. Books, equipment, furniture, and supplies destroyed or damaged must be paid for by the person responsible for the damage.

Special Education Services

If you believe your child is struggling and may qualify for some help through special education services, please contact your child’s teacher or the principal. The referral process will be explained and pursued if appropriate. Services for qualified students can include small class time, work on individual goals, speech/language therapy, occupational therapy, physical therapy, and other specific services as specified in an individual education plan.


Students are marked tardy when they arrive at or after the 7:40 bell. They must be inside the building. Students who are late don’t have a chance to put up their belongings, or begin their morning work. *Every 5 unexcused tardies and Early Sign-outs will equal one unexcused absence. The absence will be added to other absences and will count toward the Mandatory Attendance Law and LCS Promotion Policy.


Students are not permitted to make telephone calls. In emergency situations, parents will be contacted by the school office.


Students are not permitted to bring toys of any kind to school. Any items brought to school will be taken and kept in the office until a parent is able to pick item(s) up. (This includes laser pointers, radios, CD players, mp3 players, cell phones, and any hand-held games, etc.)


Parents and other visitors are always welcome to our school. All guests are required to ring the front bell to gain entrance to school. Visitors must report to the front office to sign in and receive a visitor’s sticker. Any guest in the building without a sticker will be escorted to the office by a staff member to sign in properly. Conferences, classroom observations, and volunteering must be scheduled in advance through the teacher or office staff.


Volunteers are always welcome at school. Lexington City School’s first priority is to provide a safe learning environment for all students and staff. All volunteers will be asked to have a criminal background check completed prior to any volunteer activity, including, but not limited to, individual and/or small group tutoring, chaperoning field trips, etc. The fee for criminal background check is not to exceed $55.00 and will be the responsibility of the applicant. North Carolina Compulsory Attendance Law: Class attendance and participation are critical elements in the educational process. In accordance with North Carolina Public School Law General Statute (G.S.) 115-C-378, every parent, guardian or other person in North Carolina having charge or control of a child between the ages of 7 and 16 years (or) under age 7 who is enrolled in grades K-2 shall cause such child to attend school continuously for a period equal to the time which the public school to which the child is assigned shall be in session. No person shall encourage, entice, or counsel any such student to be unlawfully absent from school…The principal will notify parents and take all steps required by G.S. 115-C-378 for excessive absences.

Lawful and Unlawful Absences

Lawful Absences: An absence that occurs due to any of the following circumstances shall be coded as lawful:

  • An illness or injury occurs which prevents the student from being physically able to attend school.

  • Quarantine is ordered by the local health officer or the State Board of Health to isolate a student from the general population.

  • A death in the immediate family (including, but not limited to, the grandparents, parents, brothers and sisters) of a student.

  • Absence due to a medical or dental appointment

  • The student is parent of a court proceeding or administrative tribunal if the student is a party to the action or under a subpoena as a witness.

  • The student participates in a religious or cultural tradition in accordance with local board policy and has prior approval from the principal/designee.

  • The student is involved in a valid educational opportunity. The absence and activity must have prior approval from the principal/designee.

Unlawful Absences: Unlawful absences are defined as:

  • A student’s willful absence from school with or without the knowledge of a parent: or

  • A student’s absence from school for any reason other than those listed above under “Lawful Absences”

Procedures for Returning after an Absence

The student shall, within three days of his/her return to school, submit appropriate documentation as to the reason for the absences(s). This documentation may include written notes/verification from parents, medical professionals, court officials or other such persons related to the absence. School officials may further specify documentation that they require. Failure to submit appropriate documentation will result in the absence being coded as unlawful.

Make-Up Work

Students are permitted to make up all work missed during an absence(s). All work must be made up within one day for each day absent following the student’s return to school unless the principal/designee determines that extenuating circumstances support an extension of this restriction.

Please note the following clarifiers:

  • Students who are absent for lawful absences will be allowed to make up these absences.

  • Students who are absent for unlawful absences will not be allowed to make up the time missed for attendance policy purpose.

  • Absences due to suspensions will not be counted in the total for maximum number of absences.

Maximum Number of Absences

There will be a maximum of sixteen (16) absences allowed for students participating in year-long programs (all elementary and middle schools) and eight (8) absences allowed for students participating in semester length programs (high school). School imposed absences (suspensions) will not be counted in this total. Students who exceed these absence limits for any reason shall not receive grade/course credit or be promoted (if applicable) to the next grade level unless they:

  • Are granted a waiver from attendance policy by the principal for an absence(s) that falls outside the previously stated guidelines


  • Attend and successfully complete a program to make-up time hour for hour and work missed due to absences in Grades 4-12. In grades K-3, each school will devise and make available for parents a plan for students to make up time for lawful absences.

Waiver Procedure

A student/parent/guardian may apply to the principal for a waiver for lawful absences (excluding suspension-type absences) due to extenuating circumstances. This request may be submitted only after the student has reached twelve (12) absences for yearlong courses/programs and six (6) absences for semester-long courses/programs.

The principal/designee will review waiver requests on a monthly basis and provide written notification to the parent/guardian of the decision. Although the principal may appoint a waiver committee to review waiver requests and make recommendations for consideration, the principal or designee will make the final determination as to the appropriateness of the waiver request.


Promotion of students in each grade K-12 shall be directly linked to the student’s attendance records. Students exceeding the maximum allowance of 16 days absent from school/class will not be promoted to the next grade in Grades K-8 or receive a unit of credit for the course in Grades 9-12. Waivers and the make-up of seat time for lawful absences will be the only allowable exceptions. Absences due to suspension do not count toward the maximum allowable absences.

Excessive Tardies/Early Sign-Outs

Students are expected to arrive on time and remain in school the full day. Tardies and early dismissals cause students to miss important information and are strongly discouraged. Five unexcused tardies or five unexcused early dismissals, or any combination of five unexcused tardies or unexcused early dismissals will be equated to one day of absence for the purpose of this policy. All schools shall allow three tardies and/or early sign-outs each semester before denying a Perfect Attendance Award. The school principal is expected to deal appropriately with those students who are chronically tardy or who leave early. (Lawful tardies and lawful early dismissals will be for the same reasons as listed under Lawful and unlawful absences) Parents must realize that class time missed due to tardies and early sign-outs shall be considered as a factor in decisions regarding promotion and retention.

Head Lice – No Pediculosis (No-Nit) Regulation

To eliminate repetitive outbreaks and epidemics of head lice and constant reinfestations in our schools, Lexington City Schools has adopted a “NO – NIT” regulation.

A student, when found to have head lice, must receive treatment with an appropriate lice (pediculosis) shampoo and AL NITS (eggs) must be removed before he or she returns to school. The child’s head will be screened upon his or her return to school. If nits are found, parents will be expected to pick up the child and keep him or her at home until ALL NITS are removed. It is recommended that parents bring the child to school on the day of reentry and that they be present when their child’s hair is rechecked. If nits are detected, the parent can see the nits that need to be removed. Parents are not required to be present at the recheck, it is only recommended.

Student Conduct

Students shall be responsible for conducting themselves in a socially acceptable manner.

Rules Governing Student Behavior

Rules governing student behavior will be set out in the student handbook of each school. The student handbook shall be developed by the school principal in accordance with the Policies of the Board of Education of the Lexington City Schools and is subject to the approval of the superintendent.

Appropriate Behavior in the Elementary Grades

The K-5 educators shall attempt to teach our students appropriate ways to interact with peers. When inappropriate interactions occur between students, the teacher or principal will work with students and parents to help students understand the consequences of such behaviors. Due consideration shall be given to the age and maturity of the students involved, the circumstances surrounding the incident, and the past behavior of the students. The Lexington City Board of Education student-to-student sexual harassment policy shall not be applied in the case of young students unless it clearly appears that there is intent on the part of the students to engage in harassment of a sexual nature. In the absence of such intent, rules which forbid other forms of personal contact or interference should be considered and applied if appropriate.

Serious Student Misconduct

The following are the policies which prohibit certain types of student conduct that constitute major offenses.

Disruption of School

A student shall not by use of violence, force, noise, or coercion, threat, intimidation, fear, passive resistance, defiance, or any other conduct willfully cause the substantial and material disruption or obstruction of any lawful mission, process or function of the school.

Neither shall a student engage in such conduct for the purpose of causing the substantial and material disruption or obstruction of any lawful mission, process, or function of the school if such a disruption or obstruction is reasonably certain to result.

Neither shall a student urge other students to engage in such conduct for the purpose of causing the substantial and material disruption, or obstruction of any lawful mission, process, or function of the school if a substantial and material disruption or obstruction is reasonably certain to result from this urging. While this list is not intended to be exclusive, the following acts—when done for the purpose of causing a substantial and material disruption or obstruction of any lawful mission, process, or function of the school—illustrate the kinds of offenses encompassed here:

  • Occupying any school building, school grounds, or part thereof with intent to deprive others of its use

  • Blocking the entrance or exit of any school building or corridor or room therein with intent to deprive others of lawful access to or from or use of the building or corridor or room.

  • Setting fire to or willfully damaging any school building or property.

  • Communicating or causing to be communicated to school personnel any threat or false report that school property may be damaged by an explosive or incendiary device or by any other means regardless or whether the communication originate on or away from school property.

  • Prevention of or attempting to prevent by physical act the convening or continued functioning of any school, class, or activity or of any lawful meeting or assembly on the school campus.

  • Preventing students from attending a class or school activity.

  • Except under the direct instruction of the principal, blocking normal pedestrian or vehicular traffic on a school campus.

  • Continually and willfully making noise or acting in any manner so as to interfere seriously with the teacher’s ability to conduct his/her class.

Damage, Destruction, or Theft of School Property A student shall not willfully cause or attempt to cause damage to school property or steal or attempt to steal school property.

Damage, Destruction, or Theft of Private Property A student shall not willfully cause or attempt to cause damage to private property or steal private property either on school grounds or during a school activity, function, or event off school campus.

Assault on a School Employee

A student shall not willfully cause or attempt to cause physical injury or behave in such a way as could reasonably cause physical injury to a school employee:

  • On the school grounds at any time,

  • Off the school grounds at a school activity, function or event

Interference with a School Employee

A student shall not willfully interfere with a school employee who is attempting to perform his or her duties.

Physical Abuse of a Student or Other Person Not Employed by the School

A student shall not willfully cause or attempt to cause bodily harm to any person:

  • On the school grounds at any time,

  • Off the school grounds at a school activity, function or event

Consequences of Serious Student Misconduct

A student found to be in violation of any of the policies governing serious student misconduct may receive punishment as severe as a long-term suspension. The student shall be guaranteed the right to due process when alleged misconduct is being investigated that could result in corporal punishment, short-term suspension, in-school suspension, long-term suspension, or expulsion. Repeated violations of minor rues are equivalent to the violation of a single major rule or regulation.

In-School or Short-Term Suspensions

  • The principal has the authority to suspend for a period of ten(10) school days or less, any student who willfully violates the rules of conduct established or in accordance with the policies of the Board of Education. A student who is suspended shall be given an opportunity to take any quarterly, semester or grading period examinations missed during a short-term suspension and to make up his or her work under guidelines established by the principle.

  • The student shall have been informed previously, either verbally or in writing, that the act of misconduct could result in suspension

  • The student shall be told of the alleged misconduct and the evidence against him or her.

  • The student shall be given the opportunity to present informally his/her knowledge of the facts and defense, if any, to the accusations.

  • If the principal or designee finds that the accusation(s) is/are true and that a suspension is warranted under the facts and circumstances, the student, parents and/or guardians shall be notified in writing, of the reason for the suspension, the type of suspension (in-school or out-of-school) and the length of the suspension. In the event parents cannot be reached to arrange transportation home, the student may be given transportation or keep on school grounds until the end of the school day.

  • The parents or guardians shall also be notified that they may request a conference with the principal to discuss the suspension.

  • If more than ten (10) students are suspended at the same time for the same act(s) of misconduct, the principal shall notify the superintendent immediately.

Long-Term Suspension

  • The principal may recommend to the superintendent the suspension, for a period in excess of ten (10) school days but not exceeding the time remaining in the school year, of any student who will fully violates the rules of conduct established by or in accordance with the policies of the Board of Education. IF A STUDENT VIOLATES POLICY AND BRINGS A WEAPON ONTO SCOOL PROPERTY, THE STUDETNS WILL BE SUSPENDED FOR 365 DAYS.

  • The student shall have been informed previously, either verbally or in writing that the act of misconduct could result in suspension.

  • Before submitting a recommendation to the superintendent, the principal shall complete beginning procedures for short-term suspension.

  • If the principal or designee finds that the accusation(s) is/are true and that a suspension is warranted under the facts and circumstances, the student, parents, and/or guardians shall be notified, in writing, either by personal delivery or by certified mail. The letter will include the following:

    • That the principal is recommending a long-term suspension

    • That the student and his or her parents or guardians may request a hearing within ten (10) school days of the principal’s recommendation before the superintendent

    • The procedures for requesting a hearing

Prior to the hearing, the student and his or her parent(s) or guardian(s) shall have the right to examine any exhibits or other evidence against the student. The hearing will be private and informal and the legal rules of evidence will not apply. The student may be represented by an attorney or a person of his or her choice. The school officials and the student shall have the right to present evidence and cross-examine any witnesses presented.

Within twenty-four hours of the hearing, the superintendent shall render a decision on all factual issues based solely on the evidence presented at the hearing. The superintendent shall notify the student and his or her parent(s) or guardian(s) within a reasonable time of the decision concerning the factual issues and the superintendent’s decision concerning the suspension. The student and his or her parent(s) or guardian(s) may appeal the decision of the superintendent to the Board of Education and have a new hearing.

Services will not be provided to a student who is placed on long-term suspension.

Corporal Punishment

The board prohibits corporal punishment, believing that other consequences are more appropriate and effective for teaching self-control. No employee, student teacher, or volunteer may use corporal punishment with any student. Reasonable force necessary to protect oneself or others is not considered corporal punishment.

Effect of Suspension on Student Upon Extra-curricular Participation

Any student who is suspended from school as punishment for violation of any rule or policy shall not be eligible to participate in any extracurricular activity for a period of seven consecutive days following the beginning of the period of suspension. Any student who is placed in in-school suspension as punishment for violation of any rule or policy shall not be eligible to participate in any extracurricular activity during the period they are in in-school suspension. For the purpose of this policy, extracurricular activity is defined as any school-sponsored activity or event other than normal classroom instruction.

Grades K-5

A student in elementary grades found to be in violation of this section of the policy will be subject to the following for selling, distributing, possession, use, or being under the influence of prohibited substances: A conference with the parents/guardians, building administrator, counselor, and teacher shall occur. A plan of action will be developed for the student. A recommendation to the CARE team and the Davidson County InterAgency Children’s Council may be made. Further actions that may be taken contingent upon the plan may include:

  • Individual counseling through the school counseling service or a private counselor

  • A recommendation for family counseling

  • A referral to Social Services


Any parent or guardian my request a transfer for his/her child to another school zone for the following school year by filing the appropriate request form with the superintendent between January 15 and May 1. Available spaces in schools will be filled according to the order in which the request forms are received in the superintendent’s office. If the parent/guardian is an employee of Lexington City Schools and requests to have his/her child release to a school outside his/her attendance zone, the transfer will be granted if space is available.

Any parent or guardian who requests a transfer to another school zone for his/her child during the school year must file the appropriate request form with the superintendent. The superintendent will consider the request and make a determination based upon the best interest of the child, the orderly and efficient administration of the public schools, the proper administration of the school to which assignment is requested, and the instruction, health, and safety of the pupils there enrolled. Transportation will be provided only if existing transportation schedules will accommodate the request. Otherwise, the parent or guardian must provide transportation to the school outside the attendance zone for the remainder of the school year.

Any parent or guardian who wishes for his/her child to remain in a school outside the attendance zone for the following school year must annually notify the superintendent in writing between January 1 and January 15. Priority will be given to those students when filling available spaces. Failure to meet the January 15 deadline will not prevent any parent or guardian from requesting a transfer for his/her child pursuant to the preceding paragraphs of this policy.


The Lexington City Schools is please to provide Internet access to its students and staff. Internet services are consistent with the educational objectives of the State of North Carolina and the Lexington City Schools. Via the Internet, students and staff can explore thousands of libraries, databases, and bulletin boards while exchanging messages with people throughout the world. The Lexington City Schools supports the Library Bill of Rights and promotes intellectual freedom. Materials are selected for schools based on the age and educational level of the students as well as the curriculum. On a global network it is impossible to control all materials; however, Lexington City Schools’ personnel will make every effort to ensure appropriate materials are accessed.


School personnel shall have full access to the Internet. Students may use Internet resources independently if they are authorized to do so by teachers or administrators, and their parents or guardians have not requested in writing that the student not be permitted access to Internet.

Responsibilities of Users

Use of the Internet is a privilege, not a right, and such use may be revoked at any time if the guidelines are not observed. Students are to sign a statement declaring that they will abide by the Internet policy. Therefore, the parents’ signature states they have read and understand the Internet policy and that the parents have the option of having their child not participate by written notification to the school principal. These include (but not limited to) the following:

Privacy: Never trespass into another’s computer folders or files. Respect others; privacy. Note that electronic mail (e-mail) is not guaranteed to be private. Those who operate email systems have access to all mail and may report unethical or illegal activities to authorities.

Safety: Do not reveal your school name and address, your personal address, or phone number to others while using Internet services.

Plagiarism: Observe copyright laws when downloading information. Appropriate bibliographic citations must be given for all information obtained via the Internet.

Vandalism: Vandalism is prohibited, e.g., deliberately damaging networks, computers, software, or data. Vandalism is defined as any malicious attempt to harm or destroy data of another user, Internet, or others. This includes the uploading or creation of computer viruses or distribution onto any network or any stand-alone computer.

Expected Behavior: Be polite. Use appropriate language. Do not swear, use vulgarities or any other inappropriate language. Do not send or display messages or pictures that may be offensive to others.

Resource Utilization: School-provided Internet services may not be used for commercial or political purposes. Users are not to use school-owned Internet accounts from any site other than the school campus.

Targeted Areas of Internet: Students are to limit their pursuit of information through electronic sources to curriculum-related activities.

Remedies and Recourse: Violations may result in a loss of access. Additional disciplinary action may be determined at the building level in line with existing practice regarding inappropriate use of resources or behavior. The system administrators will deem what is inappropriate use. Any illegal activity may result in permanent revocation of Internet privileges as well as legal action.
